Don't _*EVER*_ do that. You need to bring the instance down or "opatch apply" will fail. Then, you need to open the database in the UPGRADE mode, as well as all pluggable databases. That's when you run "datapatch". OJVM patch needs upgrade mode and cannot be installed without it. The guy telling that's OK is BS-ing you.
