Of course, the flip side of this (which I had the opportunity to observe 1st hand) is that if you happen to retain data (think email) LONGER than legally required, it becomes "discoverable" in legal action, and the judge isn't going to care how difficult it is to read that ½" tape backup from the mainframe that was "junked" 10 years ago.

Yes but they can just retain this data in the database.
