Your suspicions are correct, the contents of the file are not in correct xml syntax.
Do a search on the web and you'll find some free tools that verify the validity of an xml file from a pure syntax point of view. That way, you can say, "You said you would send me an XML file and you aren't. The output of this FREE XML syntax checker proves it. Here's your copy of it, so you can verify your XML file BEFORE you send it to me."
