We had a similar problem when installing the patchset for Oracle Client on Windows. We ended up renaming each existing .dll (.dll.old) and continuing. Worked fine.

Had a similar problem with a diff. set of files when installing patch 8.1.7.1.0b and that was on AIX. Just removed the offending files which gave a similar error to allow the patch to write a new file and it worked for us. No problems encountered so far, though I would not hesitate to say that it was a wrong practice, but took a chance and it worked. If you have backed up your systems correctly as recommended, I would say go for it.
