I don't think there's anything in the Oracle Trial License agreement that would stop Serge from downloading and trying Oracle Database 10g. After all, IBM are a huge Oracle partner, and they have Oracle software up the gnu.
As long as he
1) doesn't rebadge it 2) provide it to someone else 3) reverse engineer it 4) publish performance comparisons without Oracle's consentthen he is a free as anybody else to trial the software
