Oracle download questions

I need an honest answer. I know you can download the different versions of Oracle software (Oracle lite, 8I, etc) from their website. I also see ads on eBay selling the download versions for 20-30 dollars. They clearly state it is the downloaded version, I guess that have a fast pipeline to the internet. IS THAT LEGAL? PLease respond I need to buy a copy but certainly do not want to get in trouble with Oracle like Microsoft who has come down on some dealers I know.
