Thanks again guys, got the following explanation from DBA working on this:
"This turned out to be a snapshot problem, I copied the tables over to another schema and the distinct worked so back on the original schema I switched off (at the session level) all "non standard" options and when I switched off query_rewrite_enable the distinct worked
Further investigation showed that there was a snapshot supporting this query and that the job that had been refreshing it has disappeared, so refreshed the snapshot (and recreated the job) and the distinct now works"
