I'm not sure about that Mark, the following from Metalink 359145.1 seems to contradict it:  

"When any data, either in the dictionary or in the user data or in the usage of time zones in PL/SQL, uses the affected time zones, then the patch is needed."

Sounds to me like you need to patch 10g even if your app doesn't use the TZ datatypes - unless you don't use the affected time zones. Maybe I'm misinterpreting or missing something though?

Note that 10g uses timezone aware datatypes in the data dictionary in 10g (or so Oracle claims, I haven't gone looking for them), but as long as your app doesn't use the datatypes in question, you do not need to patch.
