SuSE got it long ago, back before 8.1.7 was released
for (any) Linux.
They still had it, even when Red Hat and Oracle had a
spat (at least in the marketing area).
SuSE knew what they were doing then (8.1.6), those
people are largely still on staff (check the archived
of the ORACLE-LINUX-L mailing list that used to be on
Fatcity).
IBM had strong ties to SuSE, particularly in the days
when some in the community feared that Red Hat was
becoming too dominant.
Most of SuSE's talent is in Nurenberg, but they had an
office in Redwood Shores. Provided that Novell leaves
SuSE alone, SuSE should continue to be a premier linux
distro.
If you plan to deploy any servers in Europe, I'd
choose SuSE. Here in the US, the marketing ties are
just too strong for the choice of supported distro to
be Red Hat. I guess its time for me to let go of the
RH 7.0/gcc/cvs/wtf? release.
