Oracle warranty vs. Support

Just need to check the following:



Bought Oracle 8 a year back, had it installed in OPS environment and been
having some problem every now and then. Oracle was to come with one year
warranty but have told us that we need to buy Oracle support to ensure that
we get the assistance from them.



This bugs our lawyers as they feel Oracle shd cover the problems under the
warranty and not force us to buy support.



Who is right?
