This is a very common debate. Does copyright law spur advancement or retard it.

As an inventor, I know that I can protect what I work hard to achieve. I work hard based on the idea that I can reap the reward later.

Society benefits from these inventions.

OTOH,   If my invention could spawn dozens of other leaps in technology but doesn't because the other inventors can't use my protected work then

society is harmed by these never invented invention.

But if you take away the intellectual property protections, why would the first guy work hard, knowing his work can be exploited.

Oracle is comfortable giving us decent access to proprietary information because they know there are laws to protect it. Without those laws would we even have Metalink for SAP to steal from? So in the reverse world, where we would allow SAP to try to benefit consumers by offering better support, Oracle just wouldn't have any publicly available support and we'd be worse off.

I would be curious to know if SAP could offer better quality support. =) Not to knock Oracle Support too hard, but as you all probably well know, it is not unheard of to end up with a newbie Support Analyst or run up against undocumented features and/or unpublished information.

I may be naive, but if a 3rd party can offer competitive services, would that not drive better market conditions for clients? Yes, I understand that the principle of stealing is essentially wrong, but I am purposefully wondering about competitive services.

And those tools are available on the web especially if you know where to find them. As far as source code is concerned, if you know the programming environment that created them then de-compiling the code is a lot easier, and there isn't a software vendor out there that does not prohibit decompilition. What is probably going to be the worse of all this is the "guilt by accusation" that's going to occur. People buying software and/or support are going to see this gorilla in the closet & wonder if their getting contaminated software or that the support their expecting simply evaporates. I've seen this happen before, it took what we thought was the best product for the job off of the table even though the case had not yet been heard in court. And I doubt very seriously that this gets resolved before the end of the year.

Good question. This appears to be related to the PeopleSoft and JDEdwards apps. Apparently they got in using privileged client access to the help site ??metalink?? and downloaded stuff they shouldn't have.

How they got source code even through that is beyond me.
